It specifies the modalities through which a document issued in one of the signatory Countries can be certified for legal purposes in all the other signatory Countries. Such a certification is called an Apostille (It is a French word, and its meaning is Certification). It is an international Certification equivalent to a Notarization in domestic law.

In India, Certificate Apostille Attestation is done by the Competent Authorities designated by the Government of India which is party to the convention. A list of these authorities is maintained by the Hague Conference on Private International Law. Examples of designated authorities for Certificate Apostille Attestation are Embassies, Ministries, Courts or Local Governments. For example, in India, the Ministry of External Affairs (MEA) or the Ministry of Foreign Affairs (MoFA) is the competent Authority to affix Apostille Attestation on the Certificate for .

To be eligible for an Apostille Attestation, the Certificate firstly must be certified by an officer recognized by the Ministry of External Affairs (MEA), Government of India. Once the designated officer or authority has certified the Certificate then the Apostille Attestation will be done by the Ministry of External Affairs (MEA) or Ministry of Foreign Affairs (MoFA), New Delhi, India, Mumbai, Chennai, Kolkata: India. In India, the Certificate Apostille Attestation itself is a printed form/sticker consisting of 11 standard fields. On the top of the Apostille sticker is the text written as “APOSTILLE”, under which the text “Convention de La Haye du 5 octobre 1961” is written (in English it is: Hague Convention of 5 October 1961). The Apostille attestation form / sticker will be placed on the back side of the original Certificate itself.

Apart from the above said process, there is an alternate Certificate Apostille / Apostilization process is also practiced in India, and this process of Certificate Apostille is in use in maximum level. In this process the Certificate issued from anywhere in India, firstly will be attested from Sub Divisional Magistrate (SDM), New Delhi after that the Certificate will be Apostilled by Ministry of External Affairs (MEA) or Ministry of Foreign Affairs (MoFA), Delhi : India. The said process is an alternate, genuine and acceptable process for maximum number of Hague Conventional Countries (HCC) across the globe. In the same time, some Countries are very particular for Certificate Apostille / Apostilization process and they require the state level Attestation / Authentication (GAD, HRD, Home Department etc) on the Certificate prior to the Apostille from Ministry of External Affairs (MEA) or Ministry of Foreign Affairs (MoFA), New Delhi, India, Mumbai, Chennai, Kolkata: India.

All the above said process, the Attestation from Notary is mandatorily require. The Attestation from Notary could be completed from anywhere in India for Indian Certificates. But some country requires the Notarization from the state of issuance of the Certificate. All the Attestation and Apostille process will be done on the original Certificate. Some Country requires the translation copy of the Apostilled Certificate issued in India in English language to their own country’s languages. The translation requirement could vary from Country to Country, as some country requires the Translated Certificate after the Apostille process and on the other hand some Country requires the Translated Certificate to be Apostilled. Also some country requires both the original as well as Translated Certificate to be Apostilled.
